1. INTRODUCTION

RightBack.com LLC (“RightBack”, “we”, “us”, and “our”) respects your privacy and complies with legal privacy requirements. This Privacy Policy should be read in conjunction with our Terms of Service. This serves as notification of the types of information collected and what may be done with the information to provide the services. By using the Platform, you consent to the practices described in this Privacy Policy.

2. SERVICES

RightBack operates as a technology platform that facilitates social networking, communication, advertising, and user-to-user transactions, including access to digital content, through licensed materials and third-party service providers. Information may be used to operate specific Platform features, including priority messaging services (PlyBy™), subscription-based access services (VIP Channels), and advertising or promotional placement systems. RightBack is not a party to such transactions. All services facilitated through the Platform, including but not limited to PlyBy™, VIP Channels, and advertising services, are provided on an “AS IS” and “AS AVAILABLE” basis without warranty of any kind.

RightBack does not act as a seller, merchant of record, or financial intermediary. RightBack is not a party to any transaction between users and does not determine pricing, control service terms, or guarantee performance.

3. INFORMATION WE COLLECT

We collect and process communications you send to us, including emails, support requests, form submissions, and other correspondence. Content and profile information you choose to share may be publicly visible or accessible to other users, and it is not the responsibility of RightBack to control how other users use or redistribute any information added to RightBack. We do not guarantee the accuracy or behavior of other users and RightBack does not have an obligation to monitor or enforce user conduct. Information you add to RightBack may be made public, including but not limited to your: name, username, rating, website, and other information added to your user profile.

The specific pieces of personal information RightBack and third parties may collect about you include your: name, age, date of birth, address, country of citizenship, social network affiliation, user rating, URL, any other information provided by the user, username, email address, phone number, password, payment information, bank information, transaction information, location, IP address, geolocation, the time of your actions, device information, acceptance of terms, changing of settings, content, audio, video, photos, message reactions, message information and/or information used to operate the Platform and its features.

RightBack and its payment processors may collect and verify identity information for usernames, URLs, and to comply with legal obligations, including know-your-customer (KYC) and anti-money laundering (AML) requirements.

Payment processors, including Stripe, may provide RightBack with limited information such as transaction status, identifiers, and payout information necessary to operate the Platform.

4. HOW WE USE INFORMATION

RightBack may use your personal information to provide and operate the Platform and its features. We use your information to:

  • Provide, operate, and maintain the Platform
  • Enable user-to-user communication and interactions
  • Facilitate Platform functionality, including transaction-related features
  • Enable payment processing through third-party providers such as Stripe
  • Verify identity and comply with applicable legal obligations, including anti-money laundering (AML) and know-your-customer (KYC) requirements
  • Improve system performance, functionality, and user experience
  • Provide customer support
  • Detect, prevent, and mitigate fraud, abuse, or unauthorized access
  • Comply with applicable laws and regulatory requirements

RightBack does not use personal information to make decisions regarding pricing, transaction terms, or service outcomes between users. RightBack does not determine pricing, control transaction terms, or participate in agreements between users.

RightBack may use information relating to user transactions, communications, and content to support tax classification, calculation, reporting, and compliance processes, including determining or facilitating how transactions are treated as digital content for applicable tax purposes.

5. PAYMENT AND FINANCIAL DATA

Users are the sellers of record for all transactions conducted through the Platform, and all payment disputes, chargebacks, and reversals are solely between users. Stripe processes payments as Direct Charges to user accounts, and RightBack does not act as an escrow agent, trustee, or fiduciary with respect to transaction proceeds. RightBack does not collect, store, or process full payment information. Payment processing is provided by third-party payment processors, including Stripe, which acts as an independent service provider and may process personal and financial data in accordance with its own policies. Payments between users are processed as direct charges to the applicable user’s Stripe account. RightBack does not act as a payment processor, merchant of record, or custodian of funds. RightBack may receive limited transaction-related information, such as user name, transaction status, amounts, and identifiers, solely for the purpose of facilitating the functionality of the Platform and services. RightBack does not provide financial, banking, or money transmission services and does not hold, receive, or control user funds.

6. INFORMATION SHARING AND DISCLOSURE

We may share your information in the following circumstances:

  • With payment processors: Including Stripe, for payment processing, identity verification (KYC), fraud prevention, and regulatory compliance
  • With service providers: Hosting providers, analytics services, infrastructure providers, and customer support tools
  • With other users: As required to enable Platform functionality and communication
  • For legal compliance: To comply with laws, regulations, subpoenas, or legal processes
  • For enforcement and safety: To detect or prevent fraud, abuse, or violations of our Terms
  • Business transfers: In connection with mergers, acquisitions, or asset transfers

RightBack does not sell personal information and does not share personal information for cross-context behavioral advertising.

7. TAX INFORMATION

RightBack may use and share transaction data, user-provided information, and content-related metadata to calculate, determine, report, and support the collection or remittance of applicable sales, use, or similar transaction-based taxes. This may include sharing such information with third-party service providers that assist with tax calculation, reporting, filing, or compliance functions. Such processing is conducted based on available data, system configurations, and applicable legal requirements, and may vary by jurisdiction.

RightBack may utilize third-party tools, including Stripe Tax and TaxJar, to assist in identifying potential tax obligations and supporting tax calculation and reporting processes based on available data. RightBack does not itself calculate, collect, or remit taxes except to the limited extent required by applicable law. Any such tools are provided for informational and technical purposes only. RightBack does not guarantee the accuracy, completeness, or correctness of any tax calculations, classifications, or determinations made by third-party services. Users remain fully responsible for their own tax compliance. Users are solely responsible for their tax obligations except to the limited extent that applicable marketplace facilitator laws require RightBack to calculate, collect, or remit transaction-based taxes. Users are solely responsible for determining, collecting, reporting, and remitting any applicable taxes associated with their activities on the Platform, except where otherwise required by applicable law.

For purposes of tax classification and reporting, user-to-user transactions (including PlyBy™ and VIP Channels) provide users with access to digital content and are treated as digital content, regardless of how such transactions are described by users. Advertising services are classified separately as promotional or marketing services.

8. USER CONTENT

You retain ownership of your content. Users grant RightBack a limited license to host, use, and display content solely for the purpose of operating the Platform. RightBack does not guarantee the accuracy, completeness, or quality of user content and has no obligation to monitor or enforce user conduct. You may exercise your privacy rights, including opting out of certain data sharing, by contacting us or using available account controls where applicable. Deleting your account is not required to exercise these rights. Automated systems may influence visibility, ranking, prioritization, and content distribution within the Platform. RightBack does not guarantee outcomes associated with such systems.

You may close your RightBack account by logging in to your RightBack account you want to close, going to the Settings page, and choosing to delete your account.

To delete your account and your information (except as mentioned herein), you may: (1) logging into your RightBack account and proceeding to the Settings page and proceeding via the prompts to delete your account, or (2) emailing support@rightback.com and proceeding through the online form using the appropriate selection.

To opt-out of RightBack having or sharing your information you may delete your account by: (1) logging into your RightBack account and proceeding to the Settings page and proceeding via the prompts to delete your account, or (2) emailing support@rightback.com and proceeding through the online form using the appropriate selection.

To fix any inaccurate information about you, you can log in to your RightBack account and update the misinformation in the appropriate location, including but not limited via your settings, menu and profile pages, or by deleting your account by: (1) logging into your RightBack account and proceeding to the Settings page and proceeding via the prompts to delete your account, or (2) emailing support@rightback.com and proceeding through the online form using the appropriate selection.

9. USER INTERACTION & RISK

RightBack does not verify user identities or conduct background checks. You are solely responsible for your interactions with other users and assume all risks associated with such interactions, including exposure to content or conduct that may be offensive, harmful, misleading, or otherwise undesirable. RightBack shall not be responsible for any consequences arising from such interactions.

10. DATA RETENTION

Retention is based on contractual necessity, legal obligations, fraud prevention, dispute resolution, and operational requirements. We retain personal data for as long as reasonably necessary to provide the Platform, comply with legal obligations (including financial and tax reporting requirements), resolve disputes, and enforce agreements. Retention periods may vary depending on the nature of the data and applicable legal requirements.

11. DATA SECURITY

We implement reasonable administrative, technical, and organizational safeguards to protect your information. However, no system is completely secure, and we do not guarantee absolute security. RightBack does not guarantee the accuracy, completeness, uninterrupted service, system availability, data integrity, or reliability of any data processed through the Platform or third-party services. This may include retaining communications submitted to us for support, legal, compliance, and operational purposes.

12. YOUR RIGHTS AND CHOICES

Subject to applicable law, you may have the right to request access to the personal information we collect about you, request correction or deletion, and request information regarding the categories of data collected, used, and shared. Exercising these rights may require identity verification and may be subject to legal limitations. Requests may require identity verification.

13. COOKIES AND TRACKING TECHNOLOGIES

We use cookies and similar technologies to maintain functionality, analyze usage, and improve user experience. You may control cookies through your browser settings.

14. THIRD-PARTY SERVICES

The Platform integrates with third-party services, including payment processors (including Stripe), hosting providers, analytics providers, affiliate tracking providers, infrastructure providers, security providers, communication processing, analytics providers, and legal or regulatory authorities. To facilitate services via RightBack, the categories of information disclosed to third parties may include: security, publishing, broadcasting, communication, cloud computing, hosting providers, data storage, data processing, payment processors, banking and payment, identification, accounting, finance, order fulfillment service providers, analytics, affiliate marketing, legal/regulatory authorities. In order to process the services available via RightBack, users give RightBack and its affiliates access to your message notification system, electronic communications system, cookies, Bluetooth, calendar, camera, contacts, microphone, reminders, sensors, text message, web beacons, internet connection, social media accounts, storage, payment processing services, email, files, photos and other information from the user’s device necessary to operate and provide the Platform. RightBack uses trusted third-parties, but is not responsible for the actions, performance, availability, data practices, and management of information by third-parties, affiliates, and service providers.

By using the Platform, you agree to Stripe’s terms and acknowledge that you maintain a direct relationship with Stripe for payment processing services. Stripe may act as an independent data controller with respect to payment-related information. Stripe may independently take actions such as delaying or withholding payouts, reversing transactions, or restricting accounts in accordance with its policies, and RightBack does not control or assume responsibility for such actions. Information related to transactions is shared between users and relevant service providers.

15. CHILDREN’S PRIVACY

The Platform is not intended for individuals under 18. We do not knowingly collect personal information from minors.

16. INTERNATIONAL USERS

Your information may be transferred to and processed in the United States. By using the Platform, you consent to such transfers.

17. NO FIDUCIARY RELATIONSHIP

RightBack does not act as a fiduciary, trustee, or custodian with respect to user data or transactions. All services are provided on a non-custodial, infrastructure-only basis.

18. CALIFORNIA PRIVACY RIGHTS (CCPA/CPRA)

RightBack does not discriminate against you for exercising your rights under the California Consumer Privacy Act (CCPA/CPRA) or other applicable laws. California residents may request access to, correction of, or deletion of their personal information, subject to legal limitations. RightBack does not sell personal information and does not share personal information for cross-context behavioral advertising. Requests may be submitted to support@rightback.com and may require identity verification.

19. AUTOMATED PROCESSING

The Platform may use automated systems for ranking, fraud detection, and functionality. These systems are not intended to produce legal or similarly significant effects, and outcomes are not guaranteed.

20. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. Changes will be reflected by updating the “Effective Date.” Continued use of the Platform constitutes acceptance of the updated policy.
